If children are involved, the court typically follows the parents' agreed-upon plan for primary residence. If needed, the court may decide based on factors such as recent living arrangements.
The court will order asset division but will not specify how assets should be divided. Couples can decide on terms independently or with a mediator.

Specific residency and nationality rules must be met to qualify for a divorce in Aruba. Here’s a quick overview to help you determine if you’re eligible:
Both Spouses are Dutch Citizens
If you and your spouse are both Dutch nationals, you qualify for a divorce in Aruba if:
- You both currently live in Aruba, or
- You both live abroad but previously resided in Aruba within the Kingdom of the Netherlands.
One Spouse Lives in Aruba
If only one spouse lives in Aruba, you may qualify for a divorce if:
- That spouse has lived in Aruba for at least 12 months or
- If that spouse is Dutch, they only need to have lived in Aruba for at least 6 months.
